Additional Provisions

License

Subject to the terms and conditions of these Terms and Conditions and the applicable Order, the Owner grants to the User a non-exclusive, non-transferable, non-sublicensable, non-assignable world-wide right and license to use this Website and the Service for personal or commercial purposes (the "License"). Restrictions for using the Service are outlined under "Terms of Use - Content on this Website - Rights regarding content on this Website - All rights reserved" and "Common Provisions" above.

The License shall only apply to the Services defined in the applicable Order and shall not extend to any future services. The Owner will offer the Services as described on the Website, during the purchasing process, and the support section. The User may only use the Service as described in the course materials, the support section, the Owner's website, or official webcasts.

The License for the use of Services granted to the User by the Owner shall, unless stated otherwise, terminate (a) upon the end of the User's life, (b) if the Owner ceases to provide the Services in their entirety, or (c) if the Owner ceases its business operations. Upon such termination, User shall not be entitled to any refunds, credits, or other compensation. The License is granted to the User personally and the rights and obligations associated therewith shall not pass to the User's heirs and may not be otherwise transferred or assigned. The Owner may ask the User to present proof of identification at any time. 

The User as an individual may install and use the Website and its Service on an unlimited number of computers provided that they are the only individual using the Service and only one copy of the Service's content is in use at any one time. A User can only log in on one device at a time to use the Service. A separate license is required for each additional use and/or individual user in all other cases. If the User is an entity or is using the volume licensing program, the Owner grants the User the right to designate one individual per License within their organization to have the sole right to use the Service in the manner provided above.

Updates

The Owner reserves the right, at its sole discretion, to add, modify or remove any features or components of its Products or Services, both before and after purchase. These changes are usually made to improve the offerings, particularly the content of online courses, and are typically based on user feedback. As long as the changes are minor in nature and do not materially affect the use of Products or Services, such changes may be made without User notice or permission. However, if any material changes are made that may significantly affect the use the Products or Services, Users will be notified in advance.

Confidentiality of specially negotiated terms or pricing

Users who have received an offer for an agreement that includes specially negotiated terms or pricing agree to keep such terms or pricing confidential. This includes all volume licensing offers and agreements. They may not disclose this information to any third party without prior written consent.

Delivery of digital content

Digital content purchased on this Website is delivered online to the device(s) chosen by Users and cannot be downloaded for offline use. An active and sufficiently fast internet connection is required to use the Products, particularly the streaming video audio content included in them. Effectiveness of Products

The online courses provided on this Website are for informational purposes only and are not intended to guarantee any specific results. They show exercise examples and provide general recommendations for implementation; the responsibility for implementation and decision-making rests solely with the User. The effectiveness of the courses may vary depending on the User's and their student's / player's skill levels, talent, experience, mental and physical abilities, and other factors. The Owner does not guarantee that the courses will work for everyone and is not responsible for any results or lack thereof that may occur as a result of using the courses. The User acknowledges that the course is provided on an "as is" basis and that the user is solely responsible for the results obtained from the use of the course.

Scope of Product support

Support is provided for technical, purchasing, and billing issues. Depending on overall demand, the Owner of the Products and Services makes a best effort to provide individualized support for the content of the online courses, however, the default method to respond to Users' questions is to directly modify the online course content as well as to collect questions and make an attempt to answer them in webcasts, FAQs, or other public forums so that all Users can benefit.

Availability and pricing of mobile apps

The Owner reserves the right to limit or discontinue offering mobile apps (available through the "Apple App Store" or "Google Play"), including content delivered through such mobile apps, without any obligation to provide prior notification to the User. In such cases, the User acknowledges that the Owner shall not be held liable for any inconvenience, loss of access, or damages that may arise as a result of such limitations or discontinuation. Prices for  Products and Services on mobile apps may vary from prices on the website.

Email newsletter & webcast registrations

By creating an account on the Owner's platform, the User agrees to receive the newsletter via email. The User also acknowledges that the Owner may use their registered email address to facilitate webcast registrations and related notifications. The User retains the option to unsubscribe at any time by utilizing the unsubscribe link provided at the bottom of the emails or by contacting support.

Use of testimonials

The Owner may use positive testimonials, feedback, or reviews provided by the User for promotional and marketing purposes without prior notice. The Owner will ensure that any such testimonials do not include the User’s full name; only the User’s first name and the initial of the last name will be used. If the User wishes to withdraw consent for the use of their testimonial, they may contact the Owner at any time.

Texas sales tax

The Owner mya register for sales tax in the State of Texas and comply with all applicable tax collection and reporting requirements. In this case, the User may be responsible for any applicable taxes on purchases, depending on their location and jurisdiction. If required by law, the Owner will collect and remit sales tax on taxable transactions. Users outside of Texas should consult their local tax authorities regarding any applicable use tax obligations.

Printing, screenshot and video capture

Except for personalized certificates, Users are prohibited from printing out, taking screenshots, recording or capturing videos of any content from the digital products, in particular online courses and webcasts. Failure to comply with this restriction is considered a breach of the acceptable use policy. 

No-AI

The Owner strictly prohibits the use, copying, downloading, or extraction of any content from this Website and its Services for the purpose of developing, training, fine-tuning, or operating artificial intelligence (AI) or machine learning (ML) systems, including but not limited to large language models, image generation models, and other automated data processing technologies, unless explicitly authorized by the Owner in writing (including electronic communication).

Users and third parties, including those accessing this Website and its Services via automated systems, are prohibited from using any content for AI or ML purposes without prior written consent. Any unauthorized use of the Website’s content for AI or ML applications constitutes a material breach of these Terms and Conditions. The Owner reserves the right to take legal action, including but not limited to blocking access, pursuing damages, and enforcing intellectual property rights against any party that violates this provision.
